Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. Arbitration and Class Action Waiver Agreement:
1. Arbitration:
By using or purchasing Vaige products or services, you agree that any controversy, claim, action, or dispute between you and Vaige arising out of or relating to: (a) these Terms, or the breach thereof; or (b) your access to or use of Vaige’s website or services or materials; or (c) any alleged violation of any federal, state, or local law, statute, or ordinance (each a “Claim”), shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.
Arbitration is a form of dispute resolution in which disputes are submitted to a neutral third party (an arbitrator) instead of a court. The arbitrator is obligated to issue a written, reasoned award. The arbitrator shall not have the power to commit errors of law, and their award may be reviewed by a court of competent jurisdiction. Each party bears its own legal fees and expenses.
1.1. Arbitration Procedures:
Claims shall be heard by a single arbitrator. Arbitrations shall be held in [Suffolk County, Massachusetts, USA], unless otherwise agreed. The arbitration shall be governed by the Federal Arbitration Act and the internal laws of Massachusetts, excluding its conflict of laws rules. If the arbitrator finds the FAA inapplicable, then New York law shall govern. All questions about enforceability or applicability of these terms are to be decided by the arbitrator, not a court.
1.2. Exclusion from Arbitration:
You may choose to opt out of this arbitration agreement within 30 days of your first purchase from Vaige. To do so, you must mail a written notice including (1) your name, (2) your address, and (3) a statement of your intent to opt out, to:

Opt-out notices must be received by the deadline. Late notices will not be valid.
2. Class Action Waiver:
You and Vaige agree to bring Claims only on an individual basis. You may not participate in a class, consolidated, or representative action against us. Unless you and Vaige agree otherwise in writing, the arbitrator may not consolidate the claims of others or preside over any class or representative proceeding. Any challenge to this Class Action Waiver must be decided by a court of competent jurisdiction, not the arbitrator.
